Authorities of occupied Crimea want to extradite Ukrainian Afghan citizen to Iran calling him an international terrorist

Russia-controlled Supreme Court of Crimea decided to leave Kabir Mokhamad, an Afghan citizen with residence permit in Ukraine, in custody with intention to extradite him to Iran, passing him as a wanted terrorist.

As the lawyers of defendant explained during the court hearing, Kabir Mokhamad was detained by Russian border guards on suspicion of being wanted by the International Police on charges of terrorism. In the border guards databases this person is identified as Niyazi Mokhamad Kabir Abdulatif.

Registration documents were presented to the court, including documents from the Afghan Embassy, that the defendant is not a man named Niyazi with patronymic Abdulatif. In addition, it was indicated that he had no problems while crossing the borders over the previous time he was in more than ten European countries, as well as in Russia.

In addition, lawyers noted that portrait examination of an expert has probabilistic nature and the comparison procedure itself was performed with procedural violations. They stressed that the defendant can be extradited only to the country of his citizenship and where he lives, while Russian law enforcers are going to hand the Ukrainian to the Iranian special services.

In conclusion, lawyers noted that General Prosecutor’s Office has not carried out any procedural actions in regard to the suspect over the past five months and asked to conduct a portrait examination in another region, while releasing Mokhamad for home arrest.

Despite these arguments, the Court of Appeal left the previous decision in force and left the Ukrainian in custody. Contrary to the defendant’s demand, this court hearing, like all previous ones, was conducted without participation of a translator, to translate into the Afghan language.
